Italy Opens Temporary Protection and Employment Access for Ukrainians

IMMIGRATION UPDATE | DPCM 28 March 2022

The DPCM of 28 March 2022 implemented temporary protection in Italy for people displaced by the war in Ukraine.

Beneficiaries could access the labour market on the basis of the temporary-protection framework without waiting for an ordinary work permit under the annual immigration quotas. The simplification concerned immigration status, not the substance of the employment relationship.

An employer still needed a compliant Italian contract, correct CCNL and classification, payroll registration, social-security and insurance coverage. Language barriers and emergency circumstances also increased the importance of clear written information and genuine consent.

Businesses should verify the individual document, retain a copy lawfully, make the mandatory hiring communication and provide understandable onboarding. Temporary immigration protection should not result in temporary employment standards.
