The Constitutional Court Reviews Collective-Dismissal Remedies

CONSTITUTIONAL COURT DECISION | Judgment no. 7/2024

Judgment no. 7/2024, deposited on 22 January, considered the remedy for employees hired under the “Jobs Act” and dismissed in breach of collective-redundancy selection criteria.

The Court did not invalidate the exclusively compensatory framework in the case before it, but its reasoning highlighted the importance of effective protection and the broader evolution of dismissal remedies.

Collective redundancies remain highly procedural. The employer must define the scope, communicate with unions and apply objective selection criteria consistently. Errors can multiply across several employees and interact with discrimination claims.

International groups should begin Italian planning before global announcements. The business rationale, affected perimeter, vacancies and selection data should be tested locally, and communications should not pre-judge a procedure that still requires consultation.
