EU LEGISLATIVE UPDATE | Directive (EU) 2024/2831
Directive (EU) 2024/2831 was published in the Official Journal on 11 November 2024, beginning the transposition period that runs to December 2026.
The Directive requires Member States to establish an effective legal presumption of employment in appropriate circumstances and introduces transparency and human-oversight safeguards for automated monitoring and decision-making.
The impact is not confined to delivery riders. A business model that allocates tasks, sets prices, evaluates performance or restricts freedom through a digital interface may raise similar questions, particularly where individuals are presented as self-employed.
Companies should map their platform relationships, compare contractual independence with actual control and review the data and algorithms used to manage workers. Changes made before a dispute are usually more credible than a reclassification exercise after inspection.
