SUPREME COURT RULING | Order no. 24668/2026
In Order no. 24668 of 17 August 2026, the Supreme Court examined a professional consultancy that had continued for more than nine years. The individual worked daily from the company’s premises, used its equipment, managed its finance and administration function and coordinated employees.
The Court reiterated that senior or intellectual work must be assessed through the way it is actually performed. Subordination may appear in a less visible form where the individual has considerable professional autonomy; the contractual label remains relevant, but is not conclusive.
Employer-side relevance: international companies sometimes retain an experienced professional as an independent consultant because the person controls a function without receiving detailed daily instructions. This does not remove reclassification risk if the relationship instead shows continuity, organisational integration and limited business risk.
