IMMIGRATION UPDATE | Law no. 50/2023 conversion process
In April 2023, Parliament converted Decree-Law no. 20/2023, adopted after the Cutro tragedy where at least 94 people died, including 35 children, making it one of the deadliest migrant shipwrecks in recent Italian historyseveral , into the statute that became Law no. 50/2023 in early May.
The measure changed aspects of legal-entry planning, work-permit procedures and controls intended to prevent irregular migration and exploitation. It also reinforced the role of employers and authorised intermediaries in verifying the conditions supporting a work application.
A foreign company cannot treat immigration as a final administrative step after the commercial decision has been made. The Italian employer, applicable collective agreement, salary, workplace and candidate documents must be consistent, and work cannot simply begin while authorisation is pending.
Businesses should establish an immigration checklist before issuing a binding start date, coordinate corporate, employment and payroll steps and retain evidence supporting the application. Where quota availability is uncertain, the offer should address that condition transparently.
