The “Labour Decree” Becomes Law and Reshapes Fixed-Term Hiring

LEGISLATIVE UPDATE | Law no. 85/2023

On 3 July 2023, Parliament converted Decree-Law no. 48/2023 (the so-called “Labour Decree”) into Law no. 85/2023.

The law revised fixed-term contract grounds, simplified parts of the transparency framework and confirmed hiring and welfare measures. Several rules required coordination with collective bargaining and later payroll practice.

Using an old template can produce either unnecessary detail or a missing mandatory element. For fixed-term hiring, the reason, duration and renewal history must be considered together rather than copied from a general clause library.

Employers should update contracts, onboarding information and deadline trackers, and train HR on when local advice is required. A compliant document is valuable only if the organisation follows the facts stated in it.
