LEGISLATIVE UPDATE | Law no. 132 of 23 September 2025
On 23 September 2025, Italy enacted Law no. 132/2025 on artificial intelligence. The statute supplemented the existing European framework (Regulation (EU) 2024/1689) and assigned national responsibilities while stating principles relevant to the use of AI in employment.
Workplace systems are sensitive because they can shape access to jobs, allocation of work, evaluation and termination. A human signature at the end of the process does not neutralise an opaque or biased system if the decision-maker relies on a score that cannot be explained or challenged.
International employers should also consider Italian remote-monitoring restrictions. If a tool can indirectly track productivity, location or conduct, the Workers’ Statute may require a trade-union agreement or administrative authorisation, in addition to privacy notices and proportionality analysis.
The immediate task is discovery: list the systems already used by HR, managers and vendors, identify what each one does and determine whether local information or consultation is required. Governance is much easier before an automated practice becomes routine.
